Article 1: General Provisions

The e-commerce website of Josatech Projects with registered office at Pinksterbloemstraat 5 – 3910 Pelt, VAT BE 0777.260.703, (hereinafter ‘Josatech Projects’) offers its customers the possibility to purchase the products from its webshop online.

Experience shows us that most problems arise from misunderstandings.
Therefore, these terms and conditions to make it clear to you, the customer, how we see things. Please do not hesitate to point out to us if anything is not clear, seems unfair to you, or could be improved.

These Terms and Conditions (“Terms and Conditions”) apply to any order placed by a visitor to this e-commerce website (“Customer”). When placing an order through the web store of Josatech Projects, the Customer must expressly accept these Terms, agreeing to the applicability of these Terms to the exclusion of all other terms and conditions. Additional terms and conditions of the Customer are excluded, except where they have been previously, in writing and expressly accepted by Josatech Projects.

Article 2: Price

All prices stated are expressed in EURO, always exclusive of VAT and all other duties or taxes that the Customer is obliged to pay.

These prices are also subject to change at any time, including during an order or once an order has been placed. When there is a price change on a product already ordered we always inform and a free cancellation is possible.

  2. Our company performs services for your business

If delivery, reservation or administrative fees are charged, this will be stated separately before settlement.

The price stated applies only to the items as described verbatim. The accompanying photographs are intended to be decorative and may contain elements not included in the price.

Article 3: Offer

Despite the fact that the online catalog and e-commerce website are compiled with the utmost care, it is still possible that the information offered is incomplete, contains material errors, or is not up to date. Obvious mistakes or errors in the offer do not bind Josatech Projects. Josatech Projects is what the accuracy and completeness of the information offered only to a means obligation, so the main features will be described. Josatech Projects shall under no circumstances be liable in the event of manifest material errors, typesetting or printing errors.

If the Customer has specific questions about e.g. sizes, color, availability, delivery time or delivery method, we ask the Customer to contact our customer service department in advance. Practical : it is best to mention the details discussed over the phone or by email in the ‘comments’ section of the order to avoid any misunderstandings.

The offer is always valid while supplies last and may be modified or withdrawn by Josatech Projects at any time. Josatech Projects cannot be held liable for the unavailability of a product. If an offer has a limited validity period or is made subject to conditions, this will be explicitly stated in the offer.

Article 4: Online purchases

you can put together products with no obligation to buy, and save them to revisit or buy later. You can abort the order at any stage without more, even in the payment module.

So you can Watch or Buy, ‘how much would it cost me…’:

the cookie memory allows you to leave the store and return to your order later.

 The Customer has the choice between the following payment methods

  • Bancontact, Ideal, Paypal and credit card

Josatech Projects is entitled to refuse an order as a result of a serious shortcoming on the part of the Customer with respect to orders involving the Customer.

Josatech Projects can also refuse an order without giving any reason, but commits itself to fully refund the already paid amount within the shortest possible time.

Article 5: Delivery and execution of the agreement

Items ordered through this webshop will be picked up at the above address or delivered to Belgium.

Unless otherwise agreed or expressly provided otherwise, the goods will be delivered to the Customer’s place of residence within 30 days of receipt of the order. 

Any visible damage and/or qualitative deficiency of an item or other shortcoming in the delivery must be reported by the Customer to info@josatech.be without delay.

The risk due to loss or damage shall pass to the Customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice was not offered by Josatech Projects.

Article 6: Retention of title

The delivered items shall remain the exclusive property of Josatech Projects until paid for in full by the Customer.

The Customer undertakes, if necessary, to draw the attention of third parties to Josatech Projects’ retention of title, e.g. to anyone who might come to seize items that have not yet been paid for in full.

Article 7: Right of withdrawal 

The provisions of this article apply only to Customers who purchase items online from Josatech Projects in their capacity as consumers.

So right of withdrawal is not meant for businesses

The Customer has the right to withdraw from the contract within a period of 14 calendar days without giving reasons.

The withdrawal period expires 14 calendar days after the day “on which the Customer or a third party designated by the Customer, other than the carrier, takes physical possession of the last good.”

Inform by an unequivocal statement (e.g. written by post, e-mail) of his decision to withdraw from the contract. The Customer may use the attached model withdrawal form for this purpose, this reduces the chance of errors, but the Customer is not obliged to do so.

In order to comply with the withdrawal period, the Customer must send his communication regarding his exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return or hand over the goods without delay, but in any case no later than 14 calendar days after the day on which he communicated his decision to withdraw from the contract to Josatech Projects, to

The Customer is on time if he returns the goods before the period of 14 calendar days has expired. ( date of shipment counts).

The direct costs of sending the goods will be borne by the Customer if   the product delivered to the customer is damaged by transport

Then Josatech Projects will refund the standard delivery charge.

The Customer treats the goods with due care, so that the goods can be returned to the store as new and unused:

All returned items are carefully examined. The basic premise here is that the consumer may only inspect the item as he would be allowed to do in a store but may not have used it. Where an item has suffered a reduction in value due to the Customer’s use, this will be charged to the Customer.

What does Josatech Projects expect from the returned goods in order to be able to pay this back?

  • In their original condition and packaging, with all accessories supplied, and instructions for use.
  • No new tape, address labels or stickers on the package.
  • No traces of use.
  • No damage to the product
  • License keys or other digital products have not been activated or used.
    If so, the right of withdrawal will lapse.


If the Customer revokes the contract, Josatech Projects shall refund to the Customer all payments received to that date from the Customer, including standard delivery charges, within a maximum of 14 calendar days of Josatech Projects being informed of the Customer’s decision to revoke the contract. For sales contracts, Josatech Projects may wait to refund until it has received all the goods back, or until the Customer has demonstrated that it has returned the goods, or until the Seller has taken back the goods if this would be the case. According to which time falls first

Revocation of Services

If the Customer has requested that the provision of services be started during the withdrawal period, the Customer will pay at least the amount of the services already performed, until the customer has notified Josatech Projects unambiguously and thus in writing by e-mail or post. . 

Any additional costs resulting from the Customer’s choice of a method of delivery other than the cheapest standard delivery offered by Josatech Projects will not be reimbursed.

Josatech Projects shall reimburse the Customer using the same means of payment with which the Customer made the original transaction, unless the Customer expressly agrees to a different form; in any case, the Customer shall not be charged for such reimbursement.

The Customer may notexercise the right of withdrawal     for: 

  1. Service agreements after the full execution of the service, such as the installation of a switch or access point.
  2. The delivery of goods manufactured or modified according to the Customer’s specifications, or which are clearly intended for a specific person; this also includes merging different products
  3. Agreements in which the Customer has specifically requested Josatech Projects to visit him to perform (urgent) repairs or maintenance;

 

Article 8: Warranty

Most products have a two-year warranty unless otherwise specified by the supplier. Extended warranty can be purchased optionally for example servers, nas systems.

To invoke the warranty, the Customer must be able to present proof of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to the Customer’s home, the Customer must contact   our customer service department and return the item to Josatech Projects at their expense. 

Upon discovery of a visible defect, the Customer must notify Josatech Projects as soon as possible. In any case, this defect must be reported within a period of 7 days after delivery or collection. Afterwards, any right to repair or replacement expires.  

The warranty (commercial and/or statutory) shall never apply to defects caused by accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, alterations or modifications to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

Article 10: Penalties for non-payment

Without prejudice to the exercise of other rights available to Josatech Projects, in the event of non-payment or late payment, the Customer shall, by operation of law and without notice, owe interest of 12% per year on the unpaid amount. In addition, the Customer shall be liable by operation of law and without notice to pay a fixed indemnity of 10% on the amount in question, with a minimum of EUR 65 per invoice.

Without prejudice to the foregoing, Josatech Projects reserves the right to take back items that have not been paid for (in full).

Article 11: Privacy

The controller, Josatech Projects respects the Belgian law of December 8, 1992 on the protection of privacy in the processing of personal data.

The personal data communicated by you will only be used for the following purposes: execution of the concluded agreement, legal archiving and storage for accounting purposes; sending to the customer of at least 1 message after the processing of the order.

You have a legal right to access and possibly correct your personal data. Subject to proof of identity (copy of identity card), you can obtain the written communication of your personal data free of charge via a written, dated and signed request to Josatech Projects. If necessary, you can also ask to correct the data that would be incorrect, incomplete or not pertinent.

In case of use of data for direct marketing: You may object, free of charge, to the use of your data for direct marketing. To this end, you can always contact Josatech Projects.

We treat your data as confidential information and will not pass it on, rent or sell it to third parties. Excluding cooperating persons to the execution of the customer’s order

The customer is responsible for keeping his login information confidential and for the use of his password. Your password is stored encrypted, therefore Josatech Projects has no access to your password.

Josatech Projects keeps online (anonymous) visitor statistics to be able to see which pages of the website are visited to what extent. This allows the site to be improved for the benefit of the customer.

Article 12: Cookies

This website uses “cookies” . A cookie is a text file placed by the website’s server in your computer’s browser or on your mobile device when you access a website.

This allows you to easily log back in and, for example, your shopping basket remains ready with what you had already prepared.

Cookies also serve to help the website analyze how users use the site in order to improve the browsing experience.

Cookies are notstrong,  used to identify persons (ie you), a cookie can only identify a machine.

The information generated by the cookie about your use of the website may be transferred to Josatech Projects’ or a third party’s secure servers.
We use this information to track how you use the website, to compile reports on website activity and to offer other services related to website activity and internet usage.

We do not collect or use information for purposes other than those described in this Privacy Policy unless we have obtained your prior consent.

You can set your internet browser in such a way that cookies are not accepted,  , so that you receive a warning when a cookie is installed or that the cookies are subsequently removed from your hard drive.   You can do this via the settings of your browser (via the help function). Keep in mind that certain graphic elements may not appear correctly, or that you will not be able to use certain applications.

Article 13: Affectation of validity – non-waivers

If any provision of these Terms is declared invalid, unlawful or void, this shall not in any way affect the validity, legality and applicability of the other provisions.

The failure at any time byJosatech Projects to enforce any of the rights enumerated in these Terms, or to exercise any right hereof, shall never be deemed a waiver of such provision and shall never affect the validity of such rights.

 

Article 14: Amendment of terms and conditions

These terms and conditions are supplemented by other terms and conditions explicitly referred to and the general sales conditions of Josatech Projects. In case of contradiction, these conditions shall prevail.

Article 15: Proof

The Customer accepts that electronic communications and backups may be used as evidence.

Article 16: Applicable law – Disputes

Belgian law shall apply, including the provisions of private international law on applicable law.

The courts of the Consumer’s place of residence shall have jurisdiction in any legal disputes. The Consumer   can also turn to the ODR platform  (http://ec.europa.eu/consumers/odr/).
